Appeals for Civil Judicial Review by the Dutch Supreme Court
The highest judicial body to hear cases in the Netherlands is the Dutch Supreme Court. The manner of litigation differs from legal proceedings before lower courts. This is because the hearing of judicial review cases calls for special expertise, requiring someone who is an expert in the chosen area of law. Judgments pronounced by District Courts and Courts of Appeal may be quashed by the Supreme Court due to incompatibility with the law or due to failure to meet the procedural requirements. As a rule, judicial review proceedings are held in close consultation with the lawyers who have handled the cases concerned in the factual proceedings.
